Council to relook at brothels signage regulations; passes Waste Management Bylaw

The Christchurch City Council has shelved a possible revocation of the Brothels (Location and Signage) Bylaw 2004

The Council considered a review of the Bylaw, which currently prohibits or regulates signage of brothels, and decided that it should continue to regulate this signage.

The Council also decided in reviewing the Bylaw not to regulate the location of brothels in Christchurch

A High Court decision in 2005 required the Council to drop an element of the Bylaw which regulated the location of brothels, determining that the location provisions within the bylaw were unreasonable.

The Council yesterday (26 November) approved a committee recommendation that the bylaw remain in force until a new bylaw controlling signage advertising commercial sexual services is adopted. The type of signage regulations to be incorporated in the new bylaw will be considered by the Council next year.

The Council also passed its new Waste Management Bylaw 2009 after accepting the Hearing Panel’s report of the submissions on the consultation for the bylaw. The new bylaw comes into effect on 1 February 2009 in time with for Council’s new kerbside waste collection service.

The new bylaw is in line with the Council Waste Management Plan 2006 and the Waste Minimisation Act 2008.

Consideration of the proposed Terms and Conditions for the operation of the kerbside collection service and the Council waste collection points was postponed to the December meeting of the Council for further clarification. While the Terms and Conditions do not form part of the bylaw, it is the bylaw that allows for the enforcement of the terms and conditions of the collection.
