The High Court has today released its judgement on the Crowns claim to strike out the Christchurch City Councils application to the Court seeking a declaratory judgement. The court has granted the Crowns application and struck out the Councils proceedings.
The Council was seeking a declaration from the High Court that any transfer of ownership of the countys roads to a company or companies, such as that proposed by the governments roading reforms, contravenes the long-standing legal right of members of the public to use the roads.
The Council is naturally disappointed with the Courts decision and will study it before making any further decisions.
