Road Reform Litigation - Appeal

The importance of fundamental citizen rights was the key factor in the City Council’s decision to request the Court of Appeal to reverse the decision of the Acting Chief Justice to strike out the Council’s request for a declaratory judgement on the rights of citizens to use public roads.

It is the Council’s view that "commercialising" public roads would fundamentally alter the traditional right of citizens to use roads as of right. The Council believes that roads exist solely for the benefit of all citizens and that it is important that the Government and the public understand that the proposed reforms would change longstanding rights held by the public.

The legal and social issues are of such importance that the Council wishes the citizens’ rights to be declared by the Courts and taken into account by the Government before it makes decisions on proposed reforms.
