THE CHRISTCHURCH CITY COUNCIL

MINUTES OF A SPECIAL MEETING OF THE CHRISTCHURCH CITY COUNCIL

HELD AT 3.00 PM ON MONDAY 23 JUNE 1997

PRESENT: The Deputy Mayor, Councillor Morgan Fahey (Chairperson), The Mayor, Ms Vicki Buck, Councillors Oscar Alpers, Carole Anderton, Graham Berry, David Buist, David Close, Graham Condon, David Cox, Anna Crighton, Newton Dodge, Carole Evans, Ishwar Ganda, Pat Harrow, Ian Howell, Alister James, Charles Manning, Garry Moore, Margaret Murray, Denis O'Rourke, Gail Sheriff, Barbara Stewart and Ron Wright.

APOLOGIES: Apologies for lateness were received and accepted from the Mayor and Councillors David Cox, Anna Crighton and Pat Harrow who arrived at 3.30 pm.

An apology for absence was received and accepted from Councillor Lesley Keast.

ABSENT: Councillor Gordon Freeman.

1. CONFIRMATION OF PROCEEDINGS TO MAKE THE CHRISTCHURCH CITY DOG CONTROL BYLAW 1997

Moved: That the motion set out in clause 1 of the Notices of Motion for the present meeting to confirm the making of the Christchurch City Dog Control Bylaw 1997 be adopted.

Councillor O'Rourke moved by way of amendment:

"1. That clause 11(1) be amended by the deletion of the words "except for the purpose of passing through and provided, in that case, that the dog is held under effective control by means of a leash".

2. That clause 11(2) be deleted."

The amendment was seconded by Councillor Anderton and when put to the meeting was declared lost on division no 1 by 7 votes to 14, the voting being as follows:

Against (14): Councillors Alpers, Berry, Buist, Close, Cox, Crighton, Dodge, Evans, Ganda, Harrow, Howell, Manning, Murray and Wright.

For (7): Councillors Anderton, Condon, James, Moore, O'Rourke, Sheriff and the Mayor.

Abstain: Councillor Fahey.

(3.30 pm the Mayor and Councillors David Cox, Anna Crighton and Pat Harrow arrived)

Councillor O'Rourke moved by way of further amendment "That clause 7 be amended to provide:

Control of Dogs in Public Places Other Than Roads

Subject to any other clause of this bylaw to the contrary, the owner or person in charge of any dog shall keep that dog under effective control by voice, sign or lease at all times while that dog is in any public place, other than roads."

The amendment was seconded by Councillor Anderton and when put to the meeting was declared carried.

Councillor Evans moved by way of further amendment "That clause 11(1) be amended by the deletion of all the words following the word "equipment" and the insertion in substitution therefor of the words "except for the purpose of passing adjacent to or through a playground on a formed footpath, in which case the dog must be held under effective control by means of a leash". The amendment was seconded by Councillor O'Rourke and when put to the meeting was declared lost.

It was then resolved that the draft resolution set out in clause 1 of Notices of Motion be adopted, subject to the incorporation in the bylaw of the revised clause 7 set out in the adopted amendment moved by Councillor O'Rourke and seconded by Councillor Anderton.

(Note: Councillors Anderton and O'Rourke requested that their votes against the adoption of the foregoing resolution be recorded.)

2. CONCLUSION

The meeting concluded at 3.50 pm.
