PROJECTS AND PROPERTY COMMITTEE

A meeting of the Projects and Property Committee
was held on Thursday 24 July 1997 at 4.00 pm

PRESENT:
Councillor Ron Wright (Chairman), The Mayor, Councillors Carole Anderton, Morgan Fahey, Ishwar Ganda, Ian Howell, Alister James, Denis O'Rourke and Gail Sheriff.

An apology for absence was received and accepted from Councillor Oscar Alpers.

The Committee reports that:

PART A - MATTERS REQUIRING A COUNCIL DECISION

1. FTC CAR PARK RR 5645

The purpose of this report is to recommend the adoption of a resolution under Section 230 of the Local Government Act 1974. The resolution is required before the purchaser is able to exercise the first right of refusal provisions contained in the agreement.

BACKGROUND

As part of the contract for the sale and purchase of the new Farmers car park, the Council has been requested to offer a right of first refusal to the developer should the Council wish to sell the property, either in whole or in part, at some date in the future. The right of first refusal excludes up to 10 car parks which may be used for other purposes at some later date. The Council's consideration and passing of this resolution will meet one of the outstanding matters agreed to in the agreement for this development.

In order to comply with the provisions of the Local Government Act, the Council should adopt the following resolution:

Resolution

Pursuant to Section 230 of the Local Government Act 1974 the Council hereby resolves to grant a right of first refusal upon the terms set out in section 7 of the agreement for sale and purchase dated 27 June 1997 between McFarlane Grain and Seed Ltd and the Council in respect of the land described in the schedule.

Schedule

All that land contained in the proposed unit plan being units 3A to 3G and units 4A to 4F (excluding up to 10 car parks) being a subdivision of the property legally described on the attached schedule.

Recommendation: That the above resolution be adopted.

 

PART B - REPORTS FOR INFORMATION

2. WESTPACTRUST CENTRE: MONTHLY REPORT RR 5665

The Committee received a report by the Major Projects Co-ordinator, bringing members of the Committee up to date on progress on the WestpacTrust Centre project.

 

3. LEASE OF SIGN OF TAKAHE

The Committee received an oral report by the Chairman that the previously proposed transfer of this lease would not now be proceeding, but that the possible transfer of the lease to another party would be the subject of a further report to the Committee in due course.

The meeting concluded at 5.00 pm.
