CITY PLAN HEARINGS COMMITTEE
4 DECEMBER 1996
An emergency meeting of the City Plan Hearings Committee
was held on Wednesday 4 December 1996 at 3.35 pm
PRESENT: Councillor Charles Manning (Chairman),
Councillors David Buist, Anna Crighton,
Newton Dodge, Lesley Keast
and Margaret Murray. Mrs Maria Tait.
APOLOGIES: Apologies for absence were received and
accepted from Mr Rex Arbuckle, Mr Alex Clark,
Mrs Cushla Dwyer and Mr Bill Edwards.
The Committee reports that:

1. APPOINTMENT OF A COMMISSIONER RR 4328
The report recommended the appointment of a Commissioner to hear certain submissions and further submissions relating to the Noise provisions of the proposed City Plan.
Panel 2 commenced the hearing of submissions in relation to Noise matters on 10 December 1996 at the Fendalton Service Centre. Four requests were received seeking the appointment of a Commissioner to hear the submissions and further submissions on Volume 3 - 11.1.3.6 - Exceptions to Rules.
The grounds of the request were, in summary, that:
1. The Council is a party to the lease of the Carrs Road Speedway.
2. A member of the proposed Hearing Panel was a member of the Community Board which considered the matter of relocating the Carrs Road speedway.
The matter was discussed with the Legal Services Manager who advised that submissions on this particular part of the proposed plan should be heard by a Commissioner. Mr David Collins, a Planning Consultant, was approached and was available to act as a Commissioner on 17 December 1996.
The City Plan Hearings Committee has as part of its terms of reference the authority "to appoint a hearings commissioner or commissioners where, in the opinion of the Committee, it is desirable that a Commissioner be appointed for a specific City Plan hearing."
The Committee resolved that Mr David Collins be appointed as a Commissioner to hear, and to recommend decisions on, submissions and further submissions relating to Volume 3 Part 11, Clause 1.3.6 of the proposed City Plan.
